CHARLOTTETOWN, P.E.I. — A 21-year-old man who went into a house through a garage with two other people and left through a window when the homeowners came home was recently given a suspended sentence and community service.
Gary Joseph Clark appeared before Chief Judge Nancy Orr in provincial court in Charlottetown where he pleaded guilty to being unlawfully in a dwelling.
Crown attorney Nathan Beck told the court that Clark was with two other people who went into a house in Stratford through an unlocked garage.
All three had been drinking and the court heard Clark’s co-accused stole two mountain bikes.
Beck said that when the homeowners came home, they heard someone in the basement.
The court heard that one of the accused told police they left the house through a window when they heard the homeowners.
Clark and the co-accused were found in a shed nearby with the stolen bikes.
Before sentencing Clark, Orr said that when someone is unlawfully in a house there is always the possibility of a confrontation when the owner comes home.
With the suspended sentence, Clark will be on probation for two years during which time he must perform 50 hours of community service or pay $10 for every hour not completed to the Upper Room.
Clark must also write an apology letter to the victims.
