Summerside man sentenced for violating probation, tossing woman's TV

CHARLOTTETOWN, P.E.I. — A Summerside man who threw a woman’s TV on the floor while he was on a probation order not to have any contact with her was sentenced recently to 90 days in jail.

Scott Ford Lutz, 35, appeared before Chief Judge Nancy Orr in provincial court in Charlottetown where he pleaded guilty to mischief and breaching his probation.

Crown attorney Jeff MacDonald told the court that on June 19 at around 8 p.m. the RCMP responded to a report that Lutz was at the victim’s home and out of control.

The victim told police Lutz was intoxicated and was hallucinating and threw her TV on the floor.

When the police arrived, Lutz wasn’t there, but they arrested him when he returned.

Lutz was on probation at the time, which included a condition he not have any contact with the victim unless he had his probation officer’s written permission.

MacDonald said Lutz never had that permission.

Got out of hand

Defence lawyer Alex Dalton told the court Lutz picked the victim up from the hospital after she had surgery several days before the incident and was caring for her. 

He was drinking and things got out of hand, Dalton said.

She also said Lutz went through addiction treatment for his alcohol use after his last release from jail, but he relapsed. 

Before hearing his sentence, Lutz said he called the provincial addictions treatment facility every day for six days leading up to the incident but was told there was no room in detox.

Lutz apologized to the victim and the court.

He also said he hoped to get off-Island treatment for his addiction.

The court heard Lutz had a 12-page criminal record and Orr said alcohol has been a factor in all of his offences.

Orr gave Lutz credit 49 days for time spent in custody after his arrest, leaving him 41 days to serve after his sentencing.
