P.E.I. farm charged after 2016 fish kill

CHARLOTTETOWN, P.E.I. - A P.E.I. farm and two farmers will be in court next month facing charges related to a fish kill in 2016 after more than 75 millimetres of rain fell on the property.

Skye View Farms, along with Alex Docherty and his son, Logan Docherty, have been charged with a violation of the federal Fisheries Act.

On Monday, defence lawyer Brandon Forbes appeared before Chief Judge Nancy Orr in provincial court in Charlottetown on their behalf.

Forbes asked for an adjournment, saying he needs more time to find experts and has found some for about half of the Crown’s expert reports in the case.

Alex Docherty was fined $1,000 in June 2017 after pleading guilty to a violation of the Pesticides Control Act for spraying a pesticide without a licence.

His licence had expired about a month before the incident.

That charge came after an investigation into the fish kill in the Clyde River, but was unrelated to the deaths.

At the time, Docherty and his farm weren’t charged in connection with the fish kill.

A report from UPEI’s climate research lab noted more than 75 millimetres of rain fell in the area in less than two hours from a localized storm on the day of the fish kill.

The matter was adjourned until Jan. 21.
