Former Corner Brook resident Herbert Penney-Flynn has waived his right to a preliminary inquiry into the alleged sex offences he’s been charged with.

The 73-year-old, who now lives in Toronto, was slated to have the inquiry — which would determine if he should be ordered to stand trial — heard at provincial court in Corner Brook Friday.
However, his lawyer, Shelley Senior, indicated the defence was not going to pursue the preliminary inquiry, thereby committing Penney-Flynn to stand trial.
He will now be arraigned in the Supreme Court of Newfoundland and Labrador, where Penney-Flynn has elected to be tried by judge alone, in the new year.
He is charged with six offences: sexual assault; indecent assault on a male; buggery; gross indecency; administering, or causing to be administered, a noxious thing; and administering, or causing to be administered, a stupefying or overpowering drug.
Five of the charges are in relation to one male victim and are alleged to have occurred in 1982.
The other charge involves a second male and is alleged to have occurred in 1988.
