The five, who range in age from 19 to 22, will appear in court again on June 9. This will be at least the third time the case has been rescheduled and it is still in its early stages.
Trish Cheverie, of legal aid, is representing the co-accused. She expressed frustration with the delays when the matter was called on Thursday.
“Your honour, it has been somewhat frustrating for defence council; there has been some comments that the matter occurred back in February and that nothing has happened since,” said Cheverie, adding that she’s still waiting on significant disclosure of evidence from the Crown.
Crown attorney John Diamond said he understood Cheverie’s frustrations but indicated that he was himself still awaiting evidence disclosure from the RCMP.
“I don’t control the investigation, I simply deal with the file as best I can. I am requesting things be dealt with, but…,” he said, letting the sentence trail off.
As of Thursday, it was his understanding that the disclosure Cheverie is waiting for will be ready in time for June 9, he added.
The incident in question took place on Feb. 5.
On that date RCMP reported receiving a call at 2:30 a.m. from a man who said several people had broken into his home, beaten him, and stole some electronic equipment.
The Mounties arrested and charged four people later that day and the fifth a couple of days later.
The victim was treated in hospital for non-life-threatening injuries and released.
The accused – Jeferson Sanders, 22, of Kensington; Joshua James Bernard, 21, of Summerside; Skyler Kenneth Fear, 21, of Miscouche; Shelby Jean Mary Doucette, 19, of Summerside; and Devon Charles Boyles, 19, of North Bedeque – all face the same five charges in relation to the incident. They include, robbery, break and enter, assault with a weapon (a baseball bat), unlawful confinement and wearing a mask during the commission of an offence.
