Eight to be sentenced July 4 for Albany home invasion

SUMMERSIDE – The sentencing of eight men charged with a violent home invasion last summer near Borden-Carleton has been adjourned until July 4.

Five of the eight individuals already know their fate and will be officially sentenced next week.

Kyle Joseph Cameron, 19, of Borden-Carleton; James Patrick Duffy, 20, of Kinkora; Joseph David Dugay, 21, of Springfield; Nathan Glen Foy, 22, of Cape Traverse; Nathan George William Noonan, 19, of Borden-Carleton; and Logan Alexander Payne, 21, have each entered guilty pleas to wearing a disguise in the commission of a crime and breaking and entering a home to commit robbery.

Lyle MacDougall, 21, of Locke Shore Road, is charged with breaking and entering to commit robbery while Aaron Charles Lee, 18, of South Freetown, is charged with robbery.

In a joint recommendation for sentencing, public defender Trish Cheverie, who represents Payne, Noonan, Foy, Lea and Dugay, and Crown prosecutor John Diamond agreed to a sentence of two years less a day for their participation in the home invasion.

Attorneys Clifford McCabe, James Gormley and Matthew MacFarlane who represent Cameron, Duffy and MacDougall, respectively, are seeking lesser sentences for their clients.

Dustin Noonan, the alleged ringleader of the home invasion, was sentenced earlier this year to three and a half years in prison after pleading guilty to breaking and entering to commit robbery and wearing a disguise in committing the crime. Noonan was identified as the principal attacker in the incident.

According to facts presented, the group, with the exception of MacDougall, went into an Albany home on Aug 17, 2012, wearing masks and some carrying various weapons, including a taser and a knife.

The victim was tased on the left arm, kicked and punched in the head and back, and robbed of his smartphone and about $1,000 in cash.

The victim required medical treatment having sustained a broken nose and other facial injuries.

While in the residence Nathan Noonan and another man were directed to go upstairs to a bedroom to look for a second individual. When Noonan attempted to enter the bedroom he was struck by a baseball bat and went back downstairs. The group then fled the building.

The Crown is calling for sentences of two years less a day, two years probation, a 10-year prohibition of possession of a firearm, the supply of a DNA sample and stay-away orders from the victim and each other for all of the accused.

Diamond argued that all eight men were aware of the plan, knew what was going to happen, knew that there would be masks and weapons involved and willingly took part in the incident.

Three of the five, under the agreed sentence of two years less a day, Payne, Noonan and Foy, agreed to be remanded into custody Friday pending the outcome of the judge’s decision on July 4. All time served by these individuals will be considered under the time spent before sentencing.

Chief Judge of the Provincial Court John Douglas adjourned the sentencing to July 4 at 1:30 p.m.
