Single punch lands man in jail

SUMMERSIDE — It was a single punch that broke the jaw of one man and put the man who threw it behind bars.

Clark Joseph Waite, 19, of Malpeque, was found guilty following a trial in March of assault causing bodily harm. Sentencing was adjourned until Tuesday to allow for a presentence report to be prepared.

That report was detailed in court.

It painted the picture of a hard-working young man with an alcohol problem.

It indicated that when Waite drinks, particularly hard liquor, he gets into trouble.

That was the case on Jan. 6, 2013.

Waite was drinking at a party in the Kensington area. He threw a punch at the victim, one blow that broke the young man’s jaw, resulting in dental reconstruction, loss of wages and damaged clothing.

Crown attorney John Diamond said since the incident, Waite was charged and has since pleaded guilty to a similar assault at the Moncton Casino in New Brunswick.

Waite had no related record.

Waite’s attorney asked that he be allowed to serve any jail time imposed on weekends so he could continue working.

Judge Jeff Lantz agreed, sentencing Waite to a 19-day intermittent sentence.

“One punch can often times lead to serious circumstances, circumstances where people die,” said Lantz. “It is lucky that the victim was not more seriously harmed or worse.”

Once that is served, Waite will be on probation for 18 months, during which time be must pay the $4,500 restitution for the victim’s dental bills and loss of wages, undergo assessment, counselling and treatment for any mental health, addiction and anger issues, and stay away from the victim.

He was also ordered to pay a $100 victim surcharge; provide police with a DNA sample and is prohibited from owning or possessing any weapons or ammunition for 10 years.
