SUMMERSIDE – An altercation outside a Summerside bar has resulted in jail time for a Summerside man.

Prince County Court House

City police were parked in the parking lot of the establishment and observed 30-year-old Masen Daniel Gallant strike another man in the face with a closed fist.

The victim fell to ground as police approached the scene.

When Gallant saw police he raised his hands in the air and was arrested and charged with assault. Both Gallant and the victim had been drinking.

Defence counsel Trish Cheverie said the victim had spit on her client prior to the assault.

In handing down the sentence, Judge Jeff Lantz said while there appeared to be some provocation for the assault when the victim spit on Gallant, “He shouldn’t have punched him.”

“One punch can cause serious injury or death,” the judge said.

In addition to the jail term, Gallant was placed on probation for six months and ordered to pay a victim fine surcharge of $100.
