The 33-year-old city man pleaded guilty in Summerside provincial court Thursday to three probation breaches, all involving him being at the grocery store, and an unrelated impaired driving charge.
In October 2012, Butler was sentenced for stealing diapers from the city store and, as part of his probation, ordered to remain away from the retailer.
But, on Nov. 15, he was caught on a surveillance camera roaming around the store, which was reported to police by Superstore’s loss prevention officer.
Then, on Nov. 29, Butler was again caught on surveillance in the store, this time getting a family photo taken for a Christmas card. A copy of the Christmas card photo was handed over to police.
On Dec. 14, Butler was once again spotted inside the store, this time buying groceries. Police were called immediately and arrested the man.
Butler also pleaded guilty to impaired driving. He was arrested after police received a complaint of him going through the Wendy’s drive-thru drunk.
He provided breath samples of 220, 180 and 190 milligrams per 100 millitres of blood, all more than double the legal limit.
Butler was jailed overnight and released the next day.
He had a previous conviction for impaired driving and five prior convictions for breaching probation.
On the breaches, Judge Jeff Lantz sentenced Butler to a total of 30 days behind bars, which he was allowed to serve on weekends since he is working full-time.
On the impaired charge, Butler was sentenced to another 15 days in jail, suspended from driving for 18 months and ordered to pay a $1,300 fine.
He was ordered to pay a total of $345 in victim surcharges.
