City man heading to jail for probation breaches, driving drunk

SUMMERSIDE — Dwayne Maurice Butler just couldn’t stay away from the Superstore.

The 33-year-old city man pleaded guilty in Summerside provincial court Thursday to three probation breaches, all involving him being at the grocery store, and an unrelated impaired driving charge.

In October 2012, Butler was sentenced for stealing diapers from the city store and, as part of his probation, ordered to remain away from the retailer.

But, on Nov. 15, he was caught on a surveillance camera roaming around the store, which was reported to police by Superstore’s loss prevention officer.

Then, on Nov. 29, Butler was again caught on surveillance in the store, this time getting a family photo taken for a Christmas card. A copy of the Christmas card photo was handed over to police.

On Dec. 14, Butler was once again spotted inside the store, this time buying groceries. Police were called immediately and arrested the man.

Butler also pleaded guilty to impaired driving. He was arrested after police received a complaint of him going through the Wendy’s drive-thru drunk.

He provided breath samples of 220, 180 and 190 milligrams per 100 millitres of blood, all more than double the legal limit.

Butler was jailed overnight and released the next day.

He had a previous conviction for impaired driving and five prior convictions for breaching probation.

On the breaches, Judge Jeff Lantz sentenced Butler to a total of 30 days behind bars, which he was allowed to serve on weekends since he is working full-time.

On the impaired charge, Butler was sentenced to another 15 days in jail, suspended from driving for 18 months and ordered to pay a $1,300 fine.

He was ordered to pay a total of $345 in victim surcharges.

    I cannot figure out why this same guy keeps getting off with a slap on the wrist. They can't do much checking into things as I know this guy isn't working . Got fired from his last job. Maybe they should check into things before they make a decision

    this person is not working at all ,the courts need to check out these things ,i have seen this many times over the years and the guys or gals have a big laugh about it after court making the court look stupid ,this need to be addressed and haul their asses back to jail for strait time and extra time for lieing ti the court

    I find it truly amazing that this must be the only place in the world where you can commit any crime that you can think up but cannot go to jail for your crimes if you have a full time job. Why bother wasting taxpayers money on a justice system that is not working except to pay high salaries to judges and their staff. It is very apparent trhat they are not there to dispense justice and look after the well being of the people who pay their salaries. PEI the land of opportunity for criminals. How is that for a better slogan then PEI the gentle island.

    Still wondering why people continue to get slaps on the wrist for breaking the law time and time again. I dont think 2 nights at Sleepy Hallow Sleep Away Camp is much of a deterent. Hows about his full time position is filled by a law abiding citizen and he does straight time. Might actually give him time to think about what he has done to wind up there instead of a sleepover party on the weekends.

    What do you have to do around here to get jail time. THREE probation violations and drunk driving leads once again to a few weekends at the Sleepy Hollow Resort playing cards and watching movies. I was always under the impression that if you broke probation then you did the initial time which was probated. That must be in Canada though and not PEI>

    just wondering if the judge ever orders to see a pay stub to prove a offender does work during the week or not because he sure wasnt on these dates if he looked at a calendar just curious

      Disgusted with our justice system if you really want to clean up our beautiful province from all the drug use and theft maybe try giving these people some real time in jail . weekends does not help these people .what kind of an example are we setting for our children ?
