Impaired by three times legal limit

SUMMERSIDE -- A city man will spend 120 days in jail following a two-vehicle collision in September in which he drove with more than three times the legal limit of alcohol in his system.
Marvin William Cousins, 44, pleaded guilty to a charge of impaired driving in Provincial Court.

SUMMERSIDE -- A city man will spend 120 days in jail following a two-vehicle collision in September in which he drove with more than three times the legal limit of alcohol in his system.
Marvin William Cousins, 44, pleaded guilty to a charge of impaired driving in Provincial Court.
The collision occurred Sept. 28 along Route 2 in Miscouche. Cousins, the driver of a Chevrolet Cavalier involved in the accident, showed obvious signs of impairment when RCMP arrived at the scene.
The court heard that Cousins' speech was so slurred he had to repeat his name three times in order for officers to decipher it. Cousins was also stumbling and holding onto the police cruiser for support.
He later registered two readings of .270 on the breathalyzer test, significantly higher than the legal limit of .08.
This is Cousins' third offence for impaired driving, with related convictions dating back to 1991.
Judge Jeff Lantz also assessed a victim's surcharge of $50 and a two-year driving prohibition. After one year of the licence suspension, Cousins will be eligible to apply for the ignition interlock system.

Gets probation for stealing cheque to buy smokes
SUMMERSIDE - A Tyne Valley man pleaded guilty to one count of theft under $5,000 in Provincial Court earlier this week.
Bryan Anthony Kinch, 22, received 12 months' probation and a suspended sentence for stealing a cheque on Oct. 6.
Police received a call regarding a Government of Canada cheque in the amount of $63.23 that had been taken from the mailbox at a neighbouring residence to where Kinch was residing.
Police attended at the scene and discovered the cheque in Kinch's coat pocket. He later provided a statement indicating his involvement in the theft.
Kinch's attorney, Trish Cheverie, said her client indicated he stole the money to buy cigarettes.
As part of the sentence, Kinch must also perform 20 hours of community service work.
